Property Tax Planning
Capital Gains and Stamp Duty Land Tax
Need help converting property portfolios into limited companies, and want to save on capital gains tax and stamp duty land tax.
Through the use of chartered tax advisors, we can incorporate buy2let portfolios that are held in personal names, whilst mitigating both Stamp Duty Land Tax (SDLT) and Capital Gains Tax (CGT) through the use of a specific HMRC approved statutory relief that has also passed in Upper Tribunal Court.
Landlords are encountering several changes in tax legislation which is turn will affect the Net Rental Income. Here is a summary of what these include.
- ‘Wear and Tear Tax’ which enabled landlords to obtain a 10% deduction from their rental income. This was abolished as of 6th of April 2016.
Stamp Duty Land Tax (SDLT) as of 1st April 2016, has increased by an additional 3% for second homes, holiday homes and buy to let properties. - Deduction of Mortgage Interest Relief for additional and/or Higher Tax Payers (45% and 40% respectively) is restricted over a 4-year period, as of 6th of April 2017
- From 2020 tax relief, will only be available at the basic tax rate of 20%. So currently, landlords can deduct mortgage interest plus other costs, before determining taxable profits.
Do you need a solution to minimise the impact of inheritance Tax (IHT).
We are able to provide our clients a unique offering through an FCA registered affiliate to mitigate Inheritance Tax, without any caps in terms of liability exposure for property landlords through the use of a combination of a HMRC approved statutory relief and the use of a specialist ‘Trust’
